Official Terms and Conditions for Entrants
General
1 These terms and conditions are the Competition Rules (“Rules”) for the Red Hot Talent Competition (“Competition”) to be conducted and produced by or on behalf of Red Funnel Ferries Limited of 12 Bugle Street, Southampton, SO14 2JY (“Event Organiser”). By participating in this event you agree to be bound by these Rules and you shall be referred to as an “Entrant”.
2 The Event Organiser reserves the right to cancel or amend the Competition or these Rules at any time without prior notice.
3 In the event of any dispute regarding any matter relating to the Competition the decision of the Event Organiser shall be final and no correspondence or discussion shall be entered into.
4 The Event Organiser is producing the Competition in conjunction with the Southern Daily Echo, the Isle of Wight County Press, Wave 105, Bestival and Britvic J2O (“Event Partners”) and references to the rights of the Event Organiser in these Rules shall extend to the benefit of the Event Partners.
Qualifying Entrants
5 Entrants must be over the age of 16. Entrants under 18 years old must be accompanied by a parent or legal guardian at all times unless otherwise agreed by the Event Organiser.
6 Entrants must be resident in the UK or Republic of Ireland and hold a valid passport. Entrants must provide the Event Organiser with documentation in order to substantiate their age (i.e. birth certificate and/or valid passport).
7 By agreeing to these terms and conditions of entry into the Competition the Entrant warrants that all information submitted is true, accurate and complete.
8 By agreeing to be an Entrant, the Entrant warrants that they have legal capacity to enter the Competition and agree to the Rules (i.e. that they are of sufficient mental capacity and are entitled to be legally bound in contract) and if under 18 years of age that a parent or legal guardian has consented to their entry of the Competition and accepts these Rules.
9 The Event Organiser reserves the right to disqualify an Entrant if an Entrant has supplied untruthful, inaccurate or misleading personal details and/or information, has failed to abide by the Rules and/or is in breach of the terms hereof. In the event any Entrant is disqualified from the Competition the Event Organiser in its sole discretion may decide whether a replacement Entrant should be selected. In this event the replacement Entrant will be subject to these Rules.
10 Entrants shall remain at all times subject to the Event Organiser’s approval of the suitability of their proposed performance.
11 Entrants must disclose to the Events Organiser details of any/all criminal/civil actions pending against them currently and/or served against them and/or any unspent convictions. Entrants may be required to undertake a Criminal Records Bureau (CRB) check.
Competition – Submission and Format
12 Each Entrant shall submit to the Event Organiser the application form (in the form produced by the Event Organiser) together with a video recording of the Entrants’ talent performance. The video recording can be submitted on a disc or a video attached to an email. The video recording must be no more than 2 minutes in duration. If the Entrant submits a disc such disc must be a good clean copy, marked with the Entrants’ name, cued and ready to start. Entrants are only allowed to submit one application form and a video recording of one performance.
13 Entrant’s video recordings will be available for the public to view online and vote from 5 to 28 March 2010 on the Southern Daily Echo, Isle of Wight Country Press, Wave 105 (tbc) and Red Funnel (tbc) websites. Those video recordings with the highest number of votes will then be put forward to a panel of judges selected at the discretion of the Event Organiser (the “Judges”) who will review each Entrant’s application form and video recording and will produce a short list of Entrants.
14 The Events Organiser will contact all Entrants to confirm whether or not they have made the short list. Short listed Entrants will be invited to compete in one of two heats (tbc). One heat will be held at a venue to be arranged in Southampton and the other heat will be held at a venue to be arranged on the Isle of Wight (tbc). The Event Organiser will notify short listed Entrants of the heat in which they will be competing.
15 The Judges will select Entrants from each heat to be put forward to the final to be held at a venue in Southampton.
16 It is strongly recommended that a performance run no more than 3 minutes for the heats and finals stage. Under no circumstances may a performance run more than 10 minutes. The performance is timed from the first vocal utterance in any vocal category and the first musical sound in any instrumental category. Entrants must present themselves to Event Organiser an hour before the heat or final commences.
17 Each Entrant who has been short listed to attend a heat or the final must notify the Event Organiser, in advance, if they intend to:
- perform physical and/or dangerous stunts, explaining the full nature of the stunt;
- use any form of equipment as part of their act. The Entrant will be responsible for bringing such equipment (provided it is suitable for the audition location) and is responsible for ensuring that such equipment is safe and/or suitable for its purposes.
18 Any decision made by the Judges is final.
Prohibited Acts
19 Baton-twirlers or similar acts using batons, machetes, knives etc., will not be accepted.
20 No Pyrotechnics, smoke or smoke-effect will be allowed at any time.
21 No animals are permitted as part of a performance. 22 No forms of nudity or sexually explicit acts will be permitted.
Prizes
22 The winner of the Competition as decided by the Judges will receive £1,000 and the opportunity to perform on the Bandstand at Bestival in September 2010.
23 The Entrant in second place in the Competition as decided by the Judges will receive £500.
24 The Entrant in third pace in the Competition as decided by the Judges will receive £250.
Copyright
25 Each Entrant grants to the Event Organiser an irrevocable, non-exclusive, non-terminable royalty free license to copy and make full use of the video recording submitted to the Event Organiser by the Entrant for any promotional purpose whatsoever. This license carries the right to grant sub-licenses and is transferable to third parties without the consent of the Entrant.
26 Each Entrant assigns to the Event Organiser the complete copyright and all other rights in all performances to be given by the Entrant in the heats and the final, which shall be for the full period of copyright. The Event Organiser shall be free to assign such rights to third parties.
27 Furthermore, any information submitted by an Entrant must be personal to and relate specifically to the Entrant. The Entrant hereby warrants that the information which they submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libelous, defamatory, obscene, indecent, harassing or threatening. If relevant, the Event Organiser reserves the right, but not the obligation, to screen, filter and/or monitor information provided by the Entrant and to edit, refuse to distribute or remove the same. This includes, without limitation, the Event Organiser’s right not to include or to remove any video recording from any website.
Publicity
28 Entrants agree that their video recording, photo and information can be used in perpetuity for promotional activity of the Event Organiser and Media Partners without compensation. The Event Organiser holds the right to use contestant's name and/or photo for any further publicity purposes.
Future Performances
29 The winner of the Competition together with those Entrants in second and third place in the Competition (“Finalists”) hereby agree that they will undertake their winning performances for the Event Organiser on the Event Organiser’s vehicle ferry from Southampton to the Isle of Wight on such days in July and August 2009 as shall be agreed with the Event Organiser. A minimum of 5 days performances will be carried out by each Finalist. Each day will require the Entrant to perform on two return vehicle ferry sailings between Southampton and the Isle of Wight or in the respective ferry terminals. The Finalists will enter into the Event Organiser’s standard contract for the provision of such performances which shall set out the fees payable to the Finalists in this regard.
Liability
30 The Event Organiser cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any Entrant entering the competition or as a result of accepting any prize.
31 Attendance at any of the Competition events (including without limitation any rehersals, heats or the final) and travel to and from such events are at the Entrants’ risk and the Event Organiser accepts no responsibility or liability in this regard.
Jurisdiction
32 The Competition and the terms and conditions of this agreement will be governed by English law.
